Q.

H1B Transfer in 13th year

I am working for company A on 12th year extension, Company A filed my labor1 in Nov 2003, and I140 for labor1 in 2005, I140 got denied in 2010, so MTR is in progress case is at appeals office, my 12th year extension was done using my labor1 and pending I140 MTR. My labor2 was filed in 2010 and it is approved and I140 for labor2 is also approved in 2010

My H1B is due in Sep 2011 for another ext, this time I would like to make use of new approved labor2 and I140 for extension

Question1.
what happens if my I140 MTR is denied, can I continue to extend H1B using my second I140, is there a problem to extend my h1b because my labor2 was filed in 10th year?

Question2.
Company B is willing to sponsor H1B, Can they transfer my h1b while extending it using labor2 and approved 140.
