Q.

H1B after 6 years

I have a question about applying a new H1B after 6 years. My H1 expires in Aug 2011 and I am returning back to my country. I know I need to wait for 1 year before I can enter US on a new H1B under quota.
Question : Can i apply in April 2012 window and travel after Aug 2012 which is one year after my exit ? or Can I only apply for a new H1 only after Aug 2012 ?

My employer is not sure on this. I need expert advise. Please clarify
