Q.

H1b Transfer

Hi,

I work for a company A (consulting),since 2008,located in NJ. It holds my H1b visa. Currently, I'm working as consultant in some other company in California. Last week, got an full time offer from another company B, located in California.

I signed a agreement with company A at time of joining, to provide 30 day notice period, if I resign, otherwise I need to pay 50k as liquidated damage.

My question, do I need to provide 30 day notice to Company A immediately to avoid paying 50k or wait until I receive H1b receipt# from company B. As per company B HR, it takes 3 weeks to get receipt# & approval (premium processing). They expect me to join in 4 weeks. Also, I cannot inform company A after 3 weeks and then provide 30days notice.

Any suggestion is truly appreciated.
