Collecting past due wages
My former employer (ABC Inc) had placed me at a client site (CLIENTTECH) through a preferred vendor (VENDORSOL). Due to Mgmt Fraud, ABC Inc suddenly stopped paying me (and all other employees) and owed me close to 4 months of pay. During these 4 months, I requested VENDORSOL to withhold the payments to ABC Inc. So VENDORSOL withheld close to $6000 out of which $4000 (gross amount) was my cut and $2000 belongs to ABC Inc. When it was clear that I would not be paid anymore, I switched employers and have a new H-1B sponsor.
My question: Given my immigration status (H-1B), can I receive payment directly from VENDORSOL for the $4000 that is owed to me? In other words, is it legal to be reimbursed by a firm that is not your H1B sponsor, given the above mentioned circumstances? Please advise.
