Q.

7th Year H1B Extension & Labor Rejection at same time.

My Green card labor had a query which has passed one year and so I applied for my 7th year extension of my H1 B.
My file reached the USCIS on 15th March 2011 and on the same day evening we got an email from Labor dept stating that my labor has been denied. But to our surprise my H1B extension got approved for 13 months on March 18th 2011.

We think that Labor dept records did not get updated and both the submission of file to USCIS for H1 extension and labor denial happened same time.

My question is Can I stay legally if my labor gets denied even after the appeal and also would USCIS send me a letter to leave the country once they get updated records from labor dept about the labor denial? Please answer the question at your earliest convenience.
