Q.

Concurrent H1b question

Status: On exempt H1b (comp A) and now looking to do H1b transfer to non-exempt (comp B). The only way to do this seems to be to get a concurrent H1b with the comp. B and then work part-time for comp A.

Questions:

1. From what I have read (http://www.avlawoffice.com/NeufeldAC21Memo.htm), if job with comp. A is terminated in future, then USCIC will deny any subsequent cap-subject H1b petition if no cap numbers are available. What does the subsequent cap-subject H1b petition mean here? H1b extensions? H1b transfers?

2. Is there a way to avoid the problem outlined in Question #1? Since I will be filing after April 1st, there will certainly be cap numbers available for this year.

3. Could you suggest any other options to avoid any issues in the future with H1b transfers?
