I'm on H1B with approved Labor & I140 with priority date of 5/09. Other details are:
1.Ist H1B from 10/1/05 to 9/30/08 but came to US in 7/06.
2.Transferred H1B to current employer in 3/08 and got H1B from 3/11/08 to 3/10/11
3.Current employer applied for H1B extension last month and got the receipt notice. Could you please advice:
1. Can I switch employer at this stage with no approval in hand or is this extension dependent on my current I140?If yes,what would be the impact if my current H1B request gets rejected during the transfer time of H1B to the new employer.
2.If not,can I switch employer once I get approval?If so,what would be the H1B extension period with my new employer?
3.Will I be able to utilize existing Priority Date(5/09) when new employer files for fresh Labor & I140
