Dear Sir, I have initiated my H-1 transfer from a company A to B on 10/4/2010. Receieved RFE after 5 months for which documents were submitted by my current employer (company B) on 3/4/2011.

1. Would I be subjected to 240 days clause after which I had to leave USA incase no decision/response is recieved from USCIS ?
2. Would it be risky to process under premium at this stage ?

Background: My existing I-94 (with company A) is valid until 9/12/2012. However they have withdrawn my H-1B during November 2010 after I resigned.
I am working for a IT firm as a Service Delivery Manager.

Please suggest.
