I joined the new company based on receipt number. I got a denial with the reason - INVALID LCA.
I have my I94 valid till 2012. My current employer refiled my H1 transfer and I got a RFE on this case - asking proof of maintaining status as of new file date.
My employr is going to reply that I was not in status while applying this new transfer and I have pay slips from current emp until the denial notice
1.Can you please let me know if my case can be approved with I797B?
2.Does USCIS approve my case considering it as consular processing though its not consular processing.
3.should I prepare for another denial?

H1 denied on USCIS website on 02/03/2011
I-94 valid until 2012
Denial notice received on Feb 11th 2011
Refiled transfer on 02/25/2011
