Q.

h1 to h4 to h1

Hi
My wife was on H1b(valid until Sept 2011) and was laid off in January 2010. She left the country and applied for an H4 at the consulate and returned on the H4. She found a job in January 2011 and the company(company B) filed for a new H1b using regular processing which is still being processed. She started working for Company B upon getting the receipt notice.(I know this is a gray area-we'll take our chances)
However, now she has found another opportunity (company C) and would like to take it up full-time.

a. Can we apply for a new H1b so that she can start working asap at Company C?

b. Does it matter which H1b petition gets approved first?

c. Is it ok to petition for 2 full time H1b jobs at different companies? (non-concurrent since B is not yet approved)

Thanks!
