Q.

Am i exempt from h1b quota?

1.In Dec 2009 my h1b got approved with validity dates dec 2009 to nov 2010.
2.After approval, in feb 2010 received RFE for client letter.
3.My client didn't provide client letter so via lawyer replied to RFE with all other supporting docs like pay stubs, timesheets, badge etc.
4. In march 2010 uscis revoked my h1 (client letter not submitted) and gave 33 days to appeal this denial.
5.since i didn't have the client letter we didn't file for motion to reopen or new h1b.
6.changed the status to f1-Tri Valley Univ
7.after the TVU shutdown news in jan,2011.i tried to apply for h1b to back in status but the quota cap reached.

My question is can i apply for h1b irrelevant to quota as i already once got h1b approved and revoked? am i exempt from h1b quota (as i was 3months on h1b status?
