Q.

H1 to H4 to H1

I have a pending H1b petition. I started as H1 from a former employer, I left the company and changed to H4 before its expiration. A new employer filed for H1 after my first H1 expired and this new case is currently pending.

1) Can I start working for the new employer while the new H1 case is pending?
2) Can this case be considered under AC21?
