I had a H1B petition that was valid from Oct 06 to Oct 08, and I have moved out of the US in June 08. Now, I am going to enter Cal, US on a H4 and want to know the following:-

1) Can a company get a new H1B petition for me based on my old petition? I presume I won't be counted towards the quota?
2) Is this technically a "transfer" or a "new petition"? Are my old paystubs required here?
3) How long would this process take? If you are not aware of the actual time in California, can you please let me know the officially published time frame.
