Q.

H1B filing

currently ,my sister is on H4 visa and she was on H1 visa till Sep 2009, 3 years on H1B visa. After that she has got the change in status to H4 and got the passport stamped with H4 visa. She never got the passport stamped with H1 visa and does not have the paystubs from the past employer. While filing for H1 now, is it considered the case of H1 renewal because she was on H1 in the past or case of H4 to H1 transfer? Are paystubs required in her case? Will not having the paystubs affect her H1B filing?
