Q.

Whether I am on H4 Status OR H1B Status

I came USA on H4 Visa in Sept 2007, Applied for H1b & got approval with I-94 card (Valid from Oct 2008 to Sept 2011).Later, I applied for SSN, but my employer never asked me to fill I-9 form and never got chance to work on H1B & ofcourse didnot get paid as well.

Now I wanted to change back to H4 Status. I enquired my employer about converting from H1B to H4, He said that, I am still in H4 Visa Status and Need not to apply for Change Of Status from H1B to H4 as I never traveled outside USA for getting H1B visa stamp in passport and not signed I-9 form and not issued joining letter.

1 If I'm on H1B Status, What are documents to be requested to my Employer for applying to COS from H1B to H4?

2 If I'm on H4 Status, which got expired on April 2009, What should be my next step?
