My situation:

H1B 6 years expiring: Feb 15, 2011
PERM EB3 Priority date: Feb 12, 2010 (Approved)
I140: Filed July 1, 2010 (Pending TSC)

If I140 processing gets delayed; can I get 1 year extension of H1B under 365 day rule? (AC21 106(a))

If answer to my question above is yes; wouldn't that make me NOT eligible for I140 premium processing?
If I have read the law correctly; I cannot apply for I140 premium processing if I am eligible for 1 year extension under the 365 day rule. Correct?

If I can apply for I140 premium processing and hence cannot get a 1 year extension of H1B,
and If I get a I140 RFE that needs time for processing; what are my options for extending H1B?

Please let me know.
