Please clarify the difference between termination and H1B revocation?My contract at client site was terminated on Oct 1,2010, however my H1B extension which was filed in April and is still "Pending", is not yet revoked by my employer (consulting company). I am currently on vacation in US. I was told I'm still 'in status'. Now if change of status to F1 takes 3 months, how do I maintain my legal status by staying in US?
Before H1B is terminated if I file for F1 and its received by USCIS will I be in valid status or does F1 have to be approved for me to be "in status", and what if H1B is cancelled after I file?
Does my H1B get cancelled as soon as I file F1 or does it get cancelled after F1 is approved?
Please help me with solution to maintain legal status.
