Q.

International travel during H1 transfer

Hi,

I am currently working on H1B visa for a non-profit employer A and have received an offer letter from non-profit employer B who is currently preparing to file for my H1B transfer. I am resigning from my current employment with employer A on 8th October 2010 and traveling to my home country ( so that I do not get out of status) until my H1B from employer B gets approved (in premium processing). I plan to enter back in US once I get new H1B approval forms from the new employer and show them at port of entry. My current I94 is valid until 2013, and my passport has H1B visa stamped until April 2011. Should this be OK or do I need to get my new H1B visa restamped ?
