Q.

H1 Stamping

Hi Indu,

My wife is presently working on H1B. Her H1 status is maintained.

Below is her status history:

Jan 2008-Sept 2008 (H4)
Oct 2008- Mar 2009 (H1- out of status- no pay stubs)
Left US on Mar 20, 2009
Reentered US April 2009 on H4 visa
April 2009- Feb 2010 (H4)
Mar 2010-present (H1- in status)

We are planning to get H1B stamped in Bahamas (We can opt for Canada/Mexico as well). Would her being "out-of-status" from Oct 2008 to Mar 2009 be an issue while stamping.How should we address it?

Our home country is India. Should we prefer to get her visa stamped in India?
