My wife H4 visa Is valid till 09-30-10. She went to india on vacation and coming back on 09-28-10.In August i got H1-B approval( till 07-15-11) from new employer.



1. Can she enter USA on 09-28-10 without any legal problems by providing my H1-B approval and latest paystubs?(considering that visa is with old employer and just 2 days left on visa)

If "YES" What will be her I94 date?Is it my h1b date 07-15-11 or 09-28-10(her current visa)?

If it is 07-15-11 , can she stay legally in usa without applying h4(i can save visa fee $300)?

If it is 09-28-10, can we apply h4 in 2 days.

2.if she is not allowed to enter what she has to do. apply h4 now only while she is in india? or stamping in india?

Clarify me all possible scenarios.
