I am working as a H1-B visa holder, 37.5 hours/week, $606.00/week, since September,2009. At that time, employer and I made an agreement that I will be a full-time employee. Since today, I thought I was a full-time employee.
Last week, my employer told me he wants to cut my 1 working day off/wk, which will also reduce my weekly salary.
I thought it's impossible to lower my wage unless he submit a new petition to USCIS, and I told my employer.
Then my employer showed me LCA form (I didnt get a copy of this form until today), and told me I am not a full-time employee, but I am getting wages hourly. Then, it is legal to lower my working time, and reduce my weekly salary, since the hourly rate(prevailing wage) will be the same. I felt so unfair, but I couldn't do anything. is it legal?
