Q.

Refiling of Labor and I 140 again if RFE is rejected

My wife is medical doctor. We have tough RFE in I 140 EB2 ROW due to masters degree mentioned in the labor and no alternative degree Indian mbbs mentioned in the section h of labor form.
Eb3 ROW is not good option as It is not current. It will take more waiting time for GC.
1) In the worst case of RFE being rejected, can we start from fresh with new labor giving position needs undergrad degree and alternate medical degree being allowable in perm section h and use the appeal case of indian mbbs doctors do qualify for eb2?
2) Can current Labor be amended to accept degree and I 140 be newly filed is this RFE I 140 for Eb2 medical doctor is rejected?
3) Do you handle the cases of Foreign Medical Graduates in EB2 ROW due to country of birth being Egypt in the PERM route to green card?
