Q.

Transfer to H4 from H1

I appeared for my H1 stamping to Consulate General New Delhi, India. The Visa officer has suspended my case under section 221(g) of the Immigration and Nationality Act (INA) until they receive some of Petitioner documents. I have submitted the docs and waiting for Consulate General response. My question is can I stamp H4 (as my spouse has H1 and is in US) visa and fly to US, without harming my H1 . And once Visa Consulate General approves my H1 then I can do a change of status to H1 from H4 . Or is there some other way to take the H4 stamping keeping my H1 active and unharm and then come back to H1 after it is approved. I have been working in US for last 1 year on my H1, its just that I visited India so had to get H1 stamp.
