Q.

CPT to H1-B

My OPT expired on end of June, 2010 and OPT extension was denied on mid of July, 2010. I joined a non-accredited university for a higher level education (doctorate), just to stay in status. I have a job offer and I can start working on CPT from first day of school which is September 1st week.

My question is, my employer wants to sponsor a H1B visa now itself. My concern is, I just joined a school and got a CPT. Will I be in trouble from immigration perspective for changing to H1B so fast? Will they think that I am misusing my CPT just to be in status and changing to H1B immediately?

If my H1 is rejected, can I stay in CPT and continue school?
