H1 Transfer beyond 6 year and valid I-140
I have a query related to H1 visa transfer. Here is the brief overview of situation I am in:
-Completed 6 years on H1B visa in May2010
-Applied for Labor under EB2 category in early Feb2009
-I140 approved in Mar2010
-Applied for H1 Extension beyond 6th year with approved I140 and got only 1 year extension valid till May2011 instead of 3 years (not sure why?)
Question: If I want to switch to a different company and new company applies for H1 transfer, will my H1 be transferred and extended for 3 years (which I should have originally received since I have a valid I-140) or will it only be transferred with its previous extension date i.e. May-2011 as my approved I-140 was filed by the previous company?
I want to weigh my options before I accept my new company's offer.
