Q.

OPT expired and H1-B denied

Hello Ms. Liladhar-Hathi,
My H1-B denied yesterday and my OPT was expired on June 23, 2010. My employer is refiling the petition and that should be done by August 16,2010. What is my status now? Shall I stay in US untill I get the response from refiling? or Should I have to leave US now? The reason for denial is: The non immigrant visa petition filed to classify the beneficiary under 101 (a)(15)(H) of the act has been denied. What is probability of approval on re-filling? I am the first person hired for web programmer position and USCIS needed any candidate prior to me had 4 year degree. The position was not exist until I got hired. All other workers (non-IT) hold 4-year degree. Is it a strong denial? or Is there a possibility of getting H1-B with refiling? what if approved?
