I am on H1B(completed 6 yrs got 1 year ext last year validity Oct242010) and EAD valid till 04/04/2011, priority date(EB2I - 12/12/2006).When I filed for my EAD I was not married so could not add my wife. My employer is not filing for a H1B extension and asking to work on EAD. My wife will go out of status if I start using EAD.
1. Is H1B transfer to an other company valid at this point? If it is will I have any issues in adding my wife to my file when my date is current? If I join other company on H1B who will have the authority on my GC?
2. If I use my EAD with my current employer.Can my wife go to community college and change status to F1? If she does it can I add her to my file when my date is current? Does she need a valid F1 Visa stamped in her passport while we add her to my file?
