My H1b expired on 6/30/10. My LCA filed with the new employer was declined due to which my h1b extension could not be filed.I filed for H4 Visa as my wife dependent on 6/30/10. LCA was re applied and it was approved on 7/20/10. My H4 is still pending.Now i need to reapply for H1b.My Lawyer says that i need to go back to my home country for the stamping as i have H4 pending status at the moment.i do not want to return my home country at the moment.The other option suggested was wait for my H4 to be approved which is going to take 2-3 months time.
If my h1 is approved should i definetely travel abroad to get the visa stamping? or could i start work with the approval?
