Q.

Spouse H4 status after H1b layoff, I have I-485 pending

My Status:
- Maintained H1b status
- I-485 pending since July 2007
- Layoff occurred on July 8 2010
- Previous employer has filed for withdrawal of
H1b as they say according to law they have
to withdraw immediately
- New Employer filing for H1b transfer this week

My spouse:
- On H4
- We got married after I filed I-485, priority
date is not current

If my spouse is out of status, what are the
options available ?
