I worked on H1 visa for 5 years in USA. I have pay stubs till Feb 2010. I became H4 visa on march 2010.

I am planning to go for h4 stamping to India. my wife is on H1 visa and I am on H4 visa now.

my wife did not go to india and her h1 is not stamped in her passport.

We both are in the usa for the last 4 years.
Her Current H1 visa is still July 2012. She has I 797 to that affect unitl July 2012 with her employer.

1) Can I travel to India and go for h4 stamping without my wife H1 visa stamped on her pass port and her old H1 being expired in pass port ?

2) Is there a risk for my case because i was originally on H1 for 5 years and now I am going on h4 visa to india ?

Kindly let me know so that I can plan a trip to go to India.
