Q.

F1 status was terminated by approved H1B

I graduated in 08 and worked for company A on OPT for 1 year. Company A applied my H1B & got approved in 09.I was laid off on 07/24/09 and transferred to new school on 08/28/09. I applied a new H1B on 5/11/10 and got to know that my F1 status was terminated on 10/1/09. That's because company A did not revoked H1B.
1. I have completed MBA & current worked on associate degree. Will it be a problem to apply F1 reinstatement?
2. If I got a consolar visa, will I be subject to the 3 years bar if I leave this country for stamping?
3. If I got rejected, can I stay in US to work on F1 reinstatment?
4. If my current employer withdraw the H1B application, can I stay in US to work on reinstatment?
5. Is it better to "continue new H1B application" or "withdraw it & work on F1 reinstatment"?
