I received an RFE for H1 transfer petitn.I joined Company B on 04/28/2010 on H1B transfer receipt basis after leaving Company A on 04/23/2010.I was put on payroll by Company B on 05/01/2010 as they pay on monthly basis.I am working on-site at Company C as contractor of Company B.Now,USCIS has asked for my latest paystubs from 04/04/2010 to 04/28/2010.I have got 2 paystubs from Company A during this period where one paystub is dated 04/09/2010 and other is 04/23/2010 as I was paid biweekly by company A.Now my question is,Will USCIS consider me out-of-status from 04/23/2010(which is last pay date on my paystub from Company A) till 05/01/2010 when I joined Company B as a contractor to work for Company C?Is it illegal to have a gap of even 1 week while changing employers?Thanks a lot.
