I would like to move my H1 to a different employer and continue work with the same Client which would help me getting more benefits as my current h1 (A) holder is not paying me well. Employer A has cut back 5% on my salary even when my client was paying the same. I have all the emails on this regard. What is the possibility of my employer A filing case here as he placed me with the client in first place. Current employer is a direct client and no intermediate layers. I am with this employer for more than 3.5 yrs now.
My current employer has the following terms with my clients contract "for a period of 1 yr the client should not hire directly / in directly under any situations." Please let me know, in this situation how to protect and do a smooth transfer.
