Q.

Labor petition appeal

My labor application got denied last year and my current employer filed an appeal in May 2009 which is still pending.My current H1B expires in June 2012.My current employer wants to give me permanent job but cannot commit until my labor situation is clear.Can I ask my current employer to withdraw my appeal and file for a new EB-2 Labor application.The appeal process seems to be taking a while. I am scared that it might be too late for me to wait since there is no gaurantee that it will get approved.

What are my options ? Please suggest .
