Q.

H1/Parolee and H4

My current H1 status is valid from 2009 to 2012. Last month I had to travel to India and I used my Advance Parole to enter US. This means I have an I94 stamped as Paroled in my passport, which is valid till June 2010.

1. What is my current status? Is it H1 or Parolee?
2. I hope it is H1, so that I my wife can apply for H4 visa next month.
3. I have pay slips for the last three months. For the months of Jan and Feb 2010 I lost my pay slips and my company couldn’t provide any duplicate pay slips either. However, my company said they could provide an Employee earning record, which lists all earnings/tax information. Will that be enough for H4 stamping or is there anything else I can do to fulfill the missing pay slip information
