Q.

old and new I94 departure issues

Case Description:
I am on H1B.I took an H1b transfer.I dont have the original H1B petition.I am travelling to India and submitting my old I94 card(valid till Sep 25,2010) while departing from US.While arriving back to US at port of entry if the CBP officer gives me a new I 94 card by making it valid till only Sep 25,2010.,does my stay in US beyond Sep 25,2010 is unlawful??or as my new I94 attached to my I797 notice end date is valid till Nov 10,2012,am I perfectly in legal/lawful status ?? The only reason I am doing this is because my employer is not giving my originals and he is suggesting this approach, which I am not convinced.I cannot make a quarrel with my employer because he
is paying me well..
