Q.

H1B Renewal Denied and I-94 Date ended - what options i have now

Hello,

I work for a consulting firm and I have been on projects without break for more than 3 years now.My 1st H1B expired on December 30th 2009 along with my I-94.
My employer filed for H1b extension (1st Renewal) in December 2009, It got online denial notice couple of days back. What are my options?
- Can I change my status to F1.
- Would my current status (H1B denied, I94 and visa expired) influence getting COS to F1 approved and/or getting CPT once I join the school.
- Is it better to apply for a new H1B from a different company rather than from the same company
- Can I Apply for a new H1B from a new company and also appeal (MTR) the denial through my current company
