Hi,

My wife recently found a job and now has a H1-B approval and will be starting her job on 18th October 2010. She is currently on H4 approval valid till 2011 (her stamped H4 visa has expired). We are planning to visit India in August.

Questions,

1. Can my wife get her H1-B visa stamped and re-enter US in August? Reason for asking, I am not sure if re-entry on this visa is allowed this early.

2. If #1 is not allowed, then if she gets H4 visa stamped. Will she be allowed to work on the same H1-B approval in October? Will the current H1 approval stay valid or the employer needs to re-file H1 since the entry to US was on a different visa type?
