Q.

Academic H1 to industry H1B

I currently work in a university on an academic H1. I have been offered a job in a company (for profit). My questions are:
1. Do I need to file for a new H1 under cap or can it be a transfer?
2. If I need to file for a new H1 under the cap, do I have to wait till october 2010 to start working for the company or can I start earlier as soon as the H1 is approved? The company would like me to start at the earliest.
3. My current job ends in july 2010.Under these circumstances can I simultaneous file for both H1B and H4 (my wife is on H1b in a non-profit institute)?
