h1B visa - claiming time of H1 spent outside country
I applied for my H1b Extension and got an RFE that Iam not eligible for another 3 years. Summary:
H1B start:10/1/2006
H1B stamped:12/8/2006
Entered USA:2/10/2007
On September,2007 I transferred my H1B to another employer and got approved till September 4,2010.
My company filed for extn until 9/4/2013 and got RFE how calculation was done as it is more than 6 years validity period.My attorney tells H1B clock starts when i enter country and I am eligible for some extra time and he is asking me to give my passport scanned copies to be sent as proof of that unclaimed time. Do you think I should be fine?can my attorney change the dates and amend petition,how is this addressed?I DO NOT have approved Labor/I140 which RFE is asking.RFE is also saying that i can submit proof of uncaptured time.
