Q.

H1-X beyond 6 years denial notice

Hi Indu,

I just wanted to share the precarious condition of my immigration status and solicit your kind advise. My employer has filed my H1-X in Dec'2009 beyond 6 years,based on my green card(Labor was filed in Nov 2008 but got an RFE which was responded back.Labor is still pending though).
My H1-X got an RFE in March'2010 which was responded and then the USCIS website is showing that they sent a denial notice to my employer(still they haven't received since 10 days). On USCIS website it says, the denial notice is for I129 PETITION FOR A NONIMMIGRANT WORKER.
Can you please advise if i can repeal in this case and get my H1-X? If not, what are my options? If i have to have to go back to my country, how can i come back to USA(L1A/B,etc) again?
