Q.

H1 Transfer - Resignation with current employer

Hi

I am on H1-B visa with my current I797 valid until Aug 2011.

I am currently employed with Company ABC (a large India based IT company) and working in Atlanta, GA.

I have accepted an offer from a new firm XYZ (a contracting company ready to place me in federal project in Washington, DC). Per the acceptance, I will have to join the new firm from May 31, 2010. However, due to various delays the LCA application is still in process.

Please provide your inputs on whether I should

1) wait for LCA approval, or
2) wait for the H1B transfer receipt, or
3) Wait for the H1B transfer completion, or
4) Go-ahead with the resignation as I am running short of notice period.

Please let me know your opinion given the current situation with USCIS.
