My friend came to US in Aug 2007 on L1 visa with company A. He applied H1b in 2008 quota with company B and he went to India in Sep 08 and re-entered US on Oct 19, 2008 continued work on L1 until 04/09 with company A on L1. In 04/09 he applied for H1 transfer with company C, obtained h4 approval petition for his wife and working with that company till now. He never worked with company B.

My question is if his wife go to India this year would she be able to get a H4 visa. My friend passport has L1 with company A. He never got it his h1 stamped.
