Q.

H1 Transfer pending - Travelling to home country

My premium - h1 transfer is going on and we replied RFE on May 10. And i'm travelling on may 14th to my home country [my wedding] and coming back jun 20th. My current visa and i-94 is valid till sept 13th 2010.

I will deposit my I-94 at airport on 14th may. What happens to my h1 transfer if they know about my i- 94 expired? Would it go to consular processing? What happens in consular processing?

Can i apply h4 for my wife on current visa, if my new h1 approves meanwhile, should i apply h4 for her on new h1?

If i get approval mean while, can i skip the h1- b stamping in My country and come back usa on june 20. Would be there any problem at POE since my visa is 3 months valid. If i get new I 797 in meanwhile, i show it for I-94 dates at POE.
