Q.

H1/F1

- Worked on H1 from March 2008 - October 2008
- Traveled to India in October 2008 and returned back to the US in May 2009 on H4 after getting married, Also, resigned from the original employer.
- Enrolled for MS program in January 2010 with expected date of degree completion May 2011

1. Would I be able to avail my original H1 petition for COS in the US when I get an offer of full time employment upon graduation in May 2011 even though the original H1 petition was approved for 3 yrs with an expiry date of Oct 2010? What if the original employer revokes the H1 petition?

2. Would it be advisable to convert back to F1 so that I can get an OPT? I didn't convert back to F1 as I wanted to avail benefits of instate tuition by being on H4.
