Q.

H1B visa: 2 -3 weeks gap between employment

My petition for H1B transfer has been submitted by my future employer last week under Premium Processing & I am finishing my employment with my current employer on May 14th.
i) Can I start my next employment on June 7th (have 2 - 3 weeks gap in between)? We hope that my H1B petition will be approved in another 10 days. One option is to start my new job on May 24th so that there is less gap between two jobs (in case its reqd from immigration viewpoint).
ii) Can I visit my home country during this 3 week's gap? I also need to get H1B visa stamp in my passport. Can I get H1B stamp with my new approved I797, even though I haven't started working for my new employer. If I don't visit my home country, is it okay to stay in US and take a 3 week break between jobs?
