Q.

lABOUR AND I-140

I have H-1b by company A and they have filed the labour/I-140 got approved and the labour priority date is oct2007.comapany A h-1 expiry was till May 2011.
I have joined a multinational consulting firm in july2008.They have started the labour process now and are saying they would file my labour in july 2010.
My 6th year H1 will expire in 25may2011 and the company wants to file the labour after the end of 5th year.I was on the assumption that they have to file the labour before the end of 5th year.What are my options?
Can i join back the older company A which stills holds my H-1 and has my labour and I-140 approved?Will this create a problem for my extension after 6th year as INS could start asking why my H-1 was not revoked by Company A.
Should I be with Company B and get labour filed?
