Q.

H1B laid of, going to new employer

Hi,I start working on H1B on July28 2008,was laid off Feb26 2010. My last pay stub pay date is 03/01/10. Since then I'm in USA looking for employer. My passport visa expiration date is April 13 2011 and I-94 till 4/13/11. Original I-797B validity is 4/22/2008 to 4/13/2011. Now I found employer and have job offer.
1.How soon can I start working?
2. Do they have to file visa transfer, and I can start working as soon as they submit the file? What is the fee here?
3. Do they have to file new H1B petition, in which case I'm not subject to CAP. Can I start working as soon as they submit the petition or after its approved? what is the normal fee and premium(15 days) fee?
4. In both cases they don't approve I-94, I can do just short trip out and in USA to get I-94, right?
