Q.

Concurrent H1 petitions

In June of 2009 I transferred my visa from an H1b to B2 (Visitors Visa). The B2 visa was approved until December 31 2009. On December 30 2009 (before expiration of B2), my employer applied for my H1b since my 6 years of employment on H1 was not exhausted. As of today 04/28/2010 I am waiting for the approval of this transfer. Also, a few weeks back USCIS requested additional evidence (RFE) to process my application. We are in the process of sending the required information in this regard. However, I have gotten an offer for a full time job with a very prestigious IT company. I was wondering if I could apply for another H1 with this company while my previous H1 (B2-H1) petition is being processed.
