Q.

H1B-F1-H1B

Dear Mr. Wilson,

I got my first master in 2007 and worked on my OPT from Dec. 2007 to July 2008. During this period, the company had applied H1b visa for me. However, in August 2008 I returned to the school to do my second master. Because my employer didn't cancel their application, my H1B status was activatied on Oct. 1 2008. After knowing this, I noticed my company and they revoked their sponsorship for my H1b. Then I went back to China and got a new F1 visa.

Now my questions is: since I can't get OPT for the second master, what should I do when seeking for a job? Can I directly relink to the H1b status without taking a new H1B quota? Do I need to wait to Oct. 1 st for the H1B status to be activated? Is there obvious risk of being rejected by the USCIS?
